The Commissioning Rule - Second discussion paper

The Ministry of Economic Development has released a second (targeted) discussion paper on the commissioning rule, raising issues for further stakeholder input.

In summary, the Ministry's preferred view is to remove the commissioning rule in section 21(3) of the Copyright Act. This would result in first ownership of copyright in all commissioned works vesting in the creator. Regarding works commissioned for private or domestic purposes, the preferred approach is to include a provision to protect consumer privacy interests.

Submissions on the second discussion paper are due by 21 August 2007.
