Items . Opt-out deadline for Google settlement extended

19-05-2009
The US court overseeing the publishing industry’s settlement in relation to Google’s book-scanning project has pushed back the deadline for authors to review and opt out of the settlement agreement. Authors now have until 4 September 2009 to review and opt out of the deal. The original deadline was 4 May.
Under the Google Print Library Project, snippets from millions of copyright-protected books have been digitised without permission. In a 2005 class action, authors and publishers brought a lawsuit against Google, claiming that this infringed their copyrights. In response to the authors’ and publishers’ claims of copyright infringement, Google argued that its conduct was permitted under the US copyright law’s doctrine of “fair use”.
In October 2008, Google and the publishing industry agreed to settle their dispute. For further information, see Copyright Win for Publishers and Authors in Google Settlement
The date for a final court hearing to decide if the settlement is fair, reasonable and adequate has also been pushed back and is now scheduled for 7 October 2009.
