Commissioning Rule Amendment Bill no longer on agenda

On the 16th of April, the Government withdrew the Copyright (Commissioning Rule) Amendment Bill. The bill proposed removing the ‘commissioning rule’ from the Copyright Act. The commissioning rule, which affects artists and photographers, vests copyright ownership in the person who commissions and pays for the work − not the artist.

The bill would have simplified the rules regarding first ownership of copyright, so that the person who creates a copyright work, rather than the commissioner of the work, would be the first owner of copyright in the work. The withdrawal of the bill means that the law will remain unchanged. Whether the creator of the work, or the person who commissions the work is the first owner of copyright continues to depend on what the work is. The exception is where there is an agreement between the parties on who will own the copyright.
