Section 92a Bill passes first reading

A bill repealing section 92A of the Copyright Act and replacing it with a three-notice regime to deter illegal file sharing has unanimously passed its first reading in Parliament.

The Copyright (Infringement File Sharing) Amendment Bill aims to set up a fair and balanced process to deal with online copyright infringements.

The major feature is the three-notice process which educates file sharers that unauthorised file sharing is illegal. The bill also provides effective methods for copyright owners to enforce their rights.

The bill extends the jurisdiction of the Copyright Tribunal, enabling it to hear complaints and award penalties of up to $15,000, based on the amount of damage sustained by the copyright owner. It also enables copyright owners to seek suspension for up to six months of an internet account through the District Court.

The bill has been referred to the Commerce Select Committee for report back to Parliament on 22 October 2010.
